A provincial court judge will determine if there is enough evidence to send a Conception Bay South man to trial in relation to a fatal February 2017snowmobile accident near Humber Valley Resort.
Thomas Whittle, 27, was charged in March, more than a year after the accident, with four offences — impaired operation of a vehicle causing death, impaired operation of vehicle causing death by exceeding 80 mg, dangerous operation of a vehicle causing death and impaired driving causing death.
Twenty-one-year-old Jystyn Pollard, who was from the same area, died as a result of injuries he sustained in the accident.
It’s alleged that Whittle was driving the snowmobile that Mr. Pollard was a passenger on when it collided with a taxi near the resort. He is alleged to have been impaired by drugs and alcohol at the time.
Whittle’s matter was called in provincial court in Corner Brook on Tuesday morning during which time a preliminary inquiry was set for Oct. 3-5.
Whittle elected trial by judge and jury in the Supreme Court of Newfoundland and Labrador during a previous appearance.
